This page describes our policy for responding to claims of copyright infringement and the procedure for submitting a DMCA takedown notice.

1. Our Commitment to Copyright Law

We take copyright infringement seriously. We will respond expeditiously to valid notices of alleged copyright infringement that comply with the DMCA. Upon receiving a proper notification, we will investigate and, where appropriate, remove or disable access to allegedly infringing material hosted on our website.

2. Filing a DMCA Takedown Notice

3. Counter-Notification Procedure

If you believe that content removed (or to which access was disabled) is not infringing, or that you have authorization from the copyright owner, the owner’s agent, or the law to post and use the material, you may send a counter-notice to our designated DMCA agent. To be valid, a counter-notice must include all of the following:

1. Your physical or electronic signature.
2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.
4. Your name, address, telephone number, and email address.
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., the jurisdiction of an appropriate court), and that you will accept service of process from the party who submitted the original infringement notice.

Upon receipt of a valid counter-notice, we may restore the removed material after providing the original complainant with a copy of the counter-notice and notifying them that we may restore the material in 10–14 business days, unless the copyright owner files a court action seeking to restrain the re-posting.

4. Repeat Infringers

In accordance with the DMCA and other applicable law, Horizon et al LLC has adopted a policy of terminating, in appropriate circumstances, accounts or users who are deemed to be repeat copyright infringers. We may also, at our sole discretion, limit access to our website for any users who infringe the intellectual property rights of others.

5. Disclaimer of Liability

Submitting a DMCA notice that knowingly contains false or misleading information may expose you to civil and criminal liability under 17 U.S.C. § 512(f) and other applicable laws.
